5 Major Problems with ProPublica’s Latest ‘Ethics’ Hit Piece on Justice Clarence Thomas.

There are five major problems with the latest so-called “ethics” attack on Justice Clarence Thomas, which this time is a hit piece from the leftwing ProPublica, attempting to kick Thomas off an upcoming Supreme Court case.

ProPublica has the vapors over the fact that Thomas flew on a private jet to a conference in Palm Springs in 2018 hosted by the network of Charles and David Koch, suggesting several ethics violations. ProPublica is legally wrong on every claim.

Two problems are that Supreme Court justices can speak at nonpartisan gatherings so long as there are no presentations to or from parties to a case currently pending before the Court, and the justice does not engage in fundraising.

First, Thomas did not present at the conference on any issues pending before the court, and no parties or lawyers on cases that were scheduled at the court made any presentations to him.

Second, although fundraising certainly takes place at such gatherings, so long as the justice does not ask for money, the fact that private citizens do so is not an ethics concern for a justice in attendance.

On various occasions when liberal justices like Elena Kagan and Sonia Sotomayor have spoken at events, fundraising people huddle about how to promote the justice’s name to raise more money off the event. But Kagan and Sotomayor violate no ethics rules when this happens, because they are not the ones engaged in fundraising.

Third, it is utterly irrelevant that the Koch Network supports filing briefs in a case currently before the court that would change the scope of the federal government’s regulatory law. Justices frequently speak at events hosted by groups that take positions on pending matters, and the upcoming case is no different.

That case, Loper Bright, asks the court to overrule a 1984 case named Chevron, where the court held that courts should defer to agency bureaucrats about whether regulations are consistent with a law passed by Congress, if Congress’s law is either silent or ambiguous about the precise legal question at issue in the regulation.

Chevron should be overruled because it is egregiously wrong and has led to terrible results. It upends bedrock principles of the rule of law for judges who defer to the almost-all-powerful government about the government’s claims as to the government’s own power over citizens and companies. If anyone should get the benefit of the doubt, it should be the powerless ordinary citizen. But better yet, there should be no deference, and judges should just interpret the law and the regulations the same way they interpret any other law, regulation, or contract. (Full disclosure: I coauthored one of the many briefs in Loper Bright urging the Supreme Court to overrule Chevron.)

The left is panicking over Loper BrightChevron gives unelected bureaucrats enhanced power over the lives of private citizens on countless issues, from energy production, to transportation, to immigration, to transgenderism in schools, to firearms. It hobbles the ability of courts to require Congress to legislate clearly and for public policy to be made by officials accountable to the people. Overruling Chevron would restore transparency and good government, so the left is trying to disqualify conservative justices like Thomas from being able to vote on it.

Fourth, ProPublica’s authors are again ignoring judicial standards on personal hospitality. During the time in question (2018), if private individuals are a friend of a Supreme Court justice and offer the justice a seat on a private airplane, that form of personal hospitality is ethically allowed. Liberal justices like the late Ruth Bader Ginsburg and the retired Stephen Breyer frequently accepted such hospitality.

Fifth, even federal judges on lower courts that are already subject to the ethics code that Senate Democrats are trying to foist on the Supreme Court – a code that would be unconstitutional, because the Supreme Court is a coequal branch of government. In May 2005, Judge Ray Randolph – a highly respected judge on the powerful U.S. Court of Appeals for the D.C. Circuit – conferred with ethics counsel at the Judicial Conference regarding a similar trip.

The judicial ethics expert at the Judicial Conference responded that the trip did not even need to be disclosed. So even if the Supreme Court could be forced into a subordinate role to Congress, like the federal appeals courts are, such trips would still be permitted.

The left’s latest desperate attempt to smear Thomas – this one from ProPublica – appears to be yet another swing and miss. And the fact that it focused so heavily on gaslighting the American people about Loper Bright shows that it is just the latest attempt at reverse court-packing to disqualify conservative justices in a brazen attempt to manipulate the outcome of a Supreme Court case on government power.

Democrats and left-wing operatives in the mainstream media say there is “no evidence” that Joe Biden did anything wrong to warrant impeachment.

This key Democrat “talking point” has been carefully crafted as the evidence and seriousness of Biden’s corrupt actions is enough to make your blood boil.

In response, the House Oversight Committee has compiled a startling list of 22 pieces of evidence that show Joe Biden’s involvement in his son’s influence-peddling scheme that raked in millions.

• 1) In July 2023, former Biden business associate Devon Archer described how Joe Biden was “The Brand” and was used to send “signals” of power, access, and influence to enrich the Biden family from foreign sources.

• 2) Devon Archer alone was aware of at least 20 times in which then-Vice President Biden spoke on speakerphone with Hunter Biden’s foreign business associates. Democrats would have Americans believe that these phone calls with then-Vice President Biden were simply to discuss the weather.

• 3) In February 2014, then-Vice President Joe Biden dined with oligarchs from Russia and Kazakhstan who funneled millions of dollars to Hunter Biden and his business associates.

• 4) In April 2015, then-Vice President Biden dined with Hunter Biden’s foreign business associates, including Ukrainian Burisma executive Vadym Pozharsky. Burisma was then being investigated by Ukrainian Prosecutor General Viktor Shokin for corruption.

• 5) Then-Vice President Biden had coffee with Hunter Biden’s Chinese business associate, Jonathan Li of BHR, in Beijing and wrote a college letter of recommendation for his daughter.

• 6) In 2015, then-Vice President Biden hosted Hunter Biden and Devon Archer and other business associates at the official residence of the Vice President. The topic of discussion was filling the top seat at the United Nations. The Kazakhstani government official who wanted the U.N. position attended both dinners at Café Milano with then-Vice President Biden.

• 7) Using the pseudonym “Robert L. Peters,” Vice President Biden was informed by his staff of a call in 2016 with President of Ukraine Petro Poroshenko. Copied on that official email? Hunter Biden, who was sitting on the board of the Ukrainian company Burisma.

• 8) On December 4, 2015, Biden business associate Eric Schwerin wrote to Kate Bedingfield in the Office of the Vice President providing quotes to use in response to media outreach regarding Hunter Biden’s role in Burisma, a Ukrainian energy company. Later that day, Ms. Bedingfield responded to Mr. Schwerin saying, “VP signed off on this[.]” According to Devon Archer, after a Burisma board of directors meeting in Dubai on the evening of December 4, 2015, Hunter Biden “called D.C.” to discuss pressure that Burisma asked him to relieve.

• 9) In May 2017, James Gilliar, a Biden family associate, emailed Hunter Biden and other associates to formalize how they would divide the profit from their deal with CEFC, a Chinese Communist Party linked energy company. Gilliar indicated Joe Biden would receive 10 percent, which has been confirmed by former Biden family associate, Tony Bobulinski.

• 10) On May 20, 2017, James Gilliar told Tony Bobulinksi, another business associate, “Don’t mention Joe being involved, it’s only when u are face to face[.] I know u know that but they are paranoid[.]”

• 11) In a September 21, 2017, email, Hunter Biden wrote that Joe Biden is his business partner and provided Joe Biden’s personal cell phone if the recipient seeks confirmation. Emails also show that Hunter Biden, CEFC officials, and Joe Biden would share offices under the Hudson West/CEFC/Biden Foundation name.

• 12) On July 30, 2017, Hunter Biden demanded money from Chinese business associates and threatened that Joe Biden was sitting next to him: “if I get a call or text from anyone involved in this other than you….I will make certain that between the man sitting next to me and every person he knows and my ability to forever hold a grudge that you will regret not following my direct.”

• 13) On August 3, 2017, Hunter Biden claimed “The Biden’s are the best I know at doing exactly what the Chairman wants from this partnership[.] Please let’s not quibble over peanuts.” The Chairman is Ye Jianming is a Chinese billionaire tied to a CCP-intelligence gathering agency. Ye stated that CEFC China’s vision “is to obtain overseas resources and serve the national strategy.”

• 14) During Rob Walker’s recorded interview with the FBI in December 2020, he told agents that Joe Biden attended a CEFC meeting.

• 15) As Vice President, Joe Biden allowed his son to travel on Air Force Two with him to court business around the world. Vice President Biden brought Hunter Biden along to at least 15 countries where he sold “The Brand” to enrich the Biden family.

• 16) Hunter Biden’s business associates reportedly visited the White House more than 80 times when Joe Biden was Vice President.

• 17) In February 2014, a report indicates then-Vice President Biden met with two of Hunter’s Mexican business associates at the White House.

• 18) In October 2015, a report says that Hunter Biden arranged a video call with his father and Mexican business partners. The next month, then-Vice President Biden hosted Mexican business partners and a Biden associate, Jeff Cooper at the Vice President’s official residence.

• 19) In February 2016, then-Vice President Biden allowed his son and Biden associate, Jeffrey Cooper, to fly to Mexico on Air Force 2 to meet with business partners.

• 20) The FBI’s June 30, 2020 FD-1023 form contains allegations that then-Vice President Joe Biden allegedly engaged in an extortion scheme where he was paid $5 million in exchange for certain actions.

• 21) Hunter’s pitch to Chinese investors was access to his father, Joe Biden. In September 2011, while his father was Vice President, Hunter wrote in an email that his value to Chinese investors “has nothing to do with me and everything to do with my last name.”

• 22) In 2019, Hunter Biden texted his daughter, claiming that, “unlike Pop I won’t make you give me half your salary.”

Sounds like a lot of Progressives. Comic Hasan Minhaj Admits He Makes Up Stories About Experiencing Racism — and Doesn’t Regret Smearing Real-Life Acquaintances.

Comedian Hasan Minhaj has admitted to inventing several first-person tales of facing discrimination — including a racist attack on his daughter — that undergird his standup comedy act and his politically-themed TV shows.

Minhaj, born in 1985 in the United States to Muslim Indian immigrants, made a name for himself on The Daily Show and his own Netflix comedy series, Patriot Act with Hasan Minhaj. He won a Peabody Award in 2018 for the short-lived (2018-2020) Netflix series.

The comedian has become a favorite among left-wingers for skewering America as a hateful and inherently racist country, often with personal stories of discrimination against him and his family.

Minhaj — who joined Comedy Central’s The Daily Show with Jon Steward in 2014 — made headlines as host of the 2017 White House Correspondents’ Association dinner (WHCD), where he ripped President Donald Trump, calling him the “liar-in-chief” and “the orange man behind the Muslim ban.”

His comedy was even panned by Saudi Arabian officials, who forced Netflix to remove one of his 2019 episodes of Patriot Act that criticized the Kingdom over the Jamal Khashoggi incident.

Minhaj relays several stories during his show. To name a few, he has claimed that a white girl refused to go to a high school homecoming dance with him, tells the tale of a “brother Eric” who infiltrated a mosque for the FBI, and even told the harrowing tale of an envelope with “white powder” in it spilling all over his daughter.

He also tells the story of Donald Trump’s son-in-law Jared Kushner arrogantly sitting in a chair reserved for a formerly imprisoned Saudi activist at a Time 100 gala in 2019. He now admits that never happened.

At long last, Minhaj has admitted that none of these stories of discrimination ever happened, though he tells them on stage and on TV as if they are real.

In an interview with the New Yorker, Minhaj explained that he tells all these false stories for “emotional truth” and that none of them really happened to him.

“Every story in my style is built around a seed of truth,” Minhaj explained. “My comedy… is 70 percent emotional truth and then 30 percent hyperbole, exaggeration, fiction.”

The comedian went on to say that, in his opinion, the “emotional truth is first. The factual truth is secondary.”

The magazine had spent some time trying to track down some of the people that Minhaj mentions in his “emotional truth” stories on stage, but it was unable to verify most of the claims he makes. The magazine also discovered that some of the people he mentions in his act have tried to get him to stop using their names and stories, but Minhaj has ignored their requests.

The “white girl” who supposedly left him standing at her front door and ditched him for homecoming, for instance, says that no such incident ever occurred and that she had turned him down many days before when he first asked her to the dance. She also says that she and her family frequently face online attacks when Minhaj fans link her real identity to the fake anecdote.

The magazine also found out that the “brother Eric” who Minhaj claims infiltrated a mosque never did any such thing. Indeed, the man said he was in prison in 2002, the year Minhaj said he was infiltrating a mosque for the FBI. Minhaj admitted that the whole story was a fiction made up for his show.

The story of his daughter being exposed to a “white powder” sent to him in the mail, supposedly causing him to take the girl to the hospital, also turns out to be fake. Minhaj says that he did receive an envelope with white powder in the mail, but he just threw it out and his daughter was never exposed to it.

Minhaj even admitted that his wife has not been happy with his race-obsessed comedy because it has put a target on their children.

“You get to say whatever you want onstage, and we have to live with the consequences. I don’t give a s**t that Time magazine thinks you’re an influencer. If you ever put my kids in danger again, I will leave you in a second,” he told the magazine that his wife said during a recent argument.

The magazine also found instances of alleged sexism in the writers room of his TV series, Patriot Act. Several female researchers who were hired as “fact-checkers” for the political stories Minhaj used as fodder for his comedy said that they were eventually shunted out of the show and that Minhaj only relied on male writers.

“[Minhaj] just assembled people around him to make him appear different and much smarter and more thoughtful. But those people—the smart people and hardworking people—were treated poorly for bringing the perspective that he is celebrated for,” one female writer told the New Yorker.

In fact, several female employees filed a lawsuit against Minhaj and Netflix for gender discrimination in a case that was eventually settled out of court. The lawsuit was only revealed after Netflix canceled Patriot Act.

Despite the flood of lies. all personalized as if they actually happened in his life, Minhaj told the magazine that he does not regret his actions.

“I don’t think I’m manipulating. I think they are coming for the emotional roller-coaster ride. To the people that are, like, ‘Yo, that is way too crazy to happen,’ I don’t care because yes, f*** yes—that’s the point. It’s grounded in truth,” he insisted.

“I think what I’m ultimately trying to do is highlight all of those stories. Building to what I think is a pointed argument as opposed to a ‘pointless riff’ of jokes,” Minhaj explained.

McCarthy grills reporter until she ‘admits’ GOP has evidence of Biden wrongdoing.

House Speaker Kevin McCarthy set social media ablaze on Thursday after he pushed back against a reporter’s assertion that he launched an impeachment inquiry “without evidence.”

“AP reported that McCarthy’s impeachment inquiry was launched ‘without evidence,’” GOP operative Arthur Schwartz posted on X, formerly known as Twitter, on Thursday. “Here’s McCarthy forcing an AP reporter to admit that there was lots of evidence to support an impeachment inquiry.”

In the clip, Associated Press reporter Farnoush Amiri asked McCarthy about fellow Republicans who have said that the investigation into President Biden has yet to show an impeachable offense at this point. “Is that an assessment you share?” Amiri asked.

“You know, an impeachment inquiry is not an impeachment,” McCarthy responded, “What an impeachment inquiry is to do is to get answers to questions. Are you concerned about all the stuff that was recently learned?”

McCarthy then went through a list of instances that many have characterized as possible evidence of wrongdoing from the president.

“Do you believe the president lied to the American public when he said he’d never talked to his son about his business dealings?” McCarthy asked “Yes or no?”

“I can’t answer that,” Amiri replied.

“Do you believe when they said the president went on conference calls? Do you believe that happened?” McCarthy asked. “That’s what the testimony says,” Amiri answered.

Do you believe the president went to Cafe Milano and had dinner with the clients of Hunter Biden, who believes he got those clients because he was selling the brand?” “That’s what the testimony said,” Amiri answered.

“Do you believe Hunter Biden, when you saw the video of him driving the Porsche, that he got $143,000 to buy that Porsche the next day? Do you believe that $3 million from the Russian oligarch that was transferred to the shell companies that the Bidens controlled after the dinner from Cafe Milano took place?” McCarthy asked.

McCarthy then asked Amiri again if she believed the president lied, to which she responded, “But is lying an impeachable offense?”

“All I’m saying is I would like to know the answer to these questions,” McCarthy said. “The American public would like to know.”

The clip was immediately picked up by conservatives on social media who slammed the narrative from many on the left who have claimed there is no evidence of wrongdoing related to President Biden and his family.

“This is what happens when reporters follow the White House’s commands to engage as activists with the Republican inquiry instead of as journalists impartially seeking facts,” GOP strategist Matt Whitlock responded on X.

“It’s on days like today where we see what the left wing foundations that bankroll the Associated Press get for their money,” former Ted Cruz spokesperson Steve Guest posted online.

“’Is lying an impeachable offense,’” The Spectator Editor Stephen L. Miller posted on X. “Oh you sweet summer child…”

In a statement to Fox News Digital, a spokesperson for the AP said, “The Associated Press stands by reporter Farnoush Amiri, an established and respected journalist covering the U.S. Congress.”

McCarthy officially gave the go ahead for an impeachment inquiry on Tuesday after saying that House Republicans have “uncovered serious and credible allegations into President Biden’s conduct.”

“Today, I am directing our House committees to open a formal impeachment inquiry into President Joe Biden,” McCarthy announced in a statement at the Capitol. “This logical next step will give our committees the full power to gather all the facts and answers for the American public.”

A few weeks before Interior Secretary Deb Haaland announced that she would withdraw more than 336,400 acres of public land from mining and drilling with a 10-mile buffer around Chaco Culture National Historical Park, Navajo Nation lawmakers passed legislation opposing the move.

Although Haaland’s action was applauded and supported by environmentalists and tribal members from the Navajo Nation and Pueblo tribes, not everyone is happy. Among the critics are Navajo allotment holders who are worried about what this will do to their livelihood.

Navajo tribal leaders also voiced displeasure, including Speaker Crystalyne Curley and President Buu Nygren, who both released statements about the 10-mile radius buffer zone.

“The Secretary’s action undermines our sovereignty and self-determination,” said Nygren. “Despite my concerns and denunciation, the Department of Interior has moved forward, which is highly disappointing. Secretary Haaland’s decision impacts Navajo allottees but also disregards the tribe’s choice to lease lands for economic development. Ultimately, this decision jeopardizes future economic opportunities, while at the same time placing some 5,600 Navajo allottees in dire financial constraints.”

The legislation, passed in April by Navajo Nation lawmakers, rescinded the previous administration’s bill opposing H.R.2181 and S.1079, the Chaco Cultural Heritage Area Protection Act of 2019, and recommending the proposed buffer zone be reduced to five miles, rather than 10 miles that encompass the 336,400-acre land withdrawal.

The new bill does not support any buffer zone and opposes the intent for any withdrawal.

Haaland said the decision to create the buffer came after “significant consultation” with other tribes, and she noted that the 20-year withdrawal applies only to public lands and federal mineral holdings and does not apply to minerals owned by private, state or tribal entities.

It also does not affect valid existing leases. Production from existing wells could continue, additional wells could be drilled on existing leases, and Navajo Nation allottees can continue to lease their minerals.

But former Navajo Council Delegate Mark Freeland had reported during an April 2022 government-to-government consultation meeting that those who could be most deeply affected are those who live around Chaco Canyon, and who are the ones being ignored on this issue.

“The White House, as did Congress, stated that the rule would not apply to individual Indian allotments or to minerals within the area owned by private, state, or tribal entities,” Freeland said. “In reality, the rule would have a devastating impact because the indirect effect would make the allottees’ land primarily worthless from the standpoint of energy extraction.”

He reported that withdrawal of land affects 53 individual allotments, generating $6.2 million a year in royalties for approximately 5,462 allottees. Many Navajo families rely on this income to meet their daily needs. It is estimated that 418 unleased allotments are also associated with about 16,615 allottees, and the withdrawal could adversely affect well over 22,000 allottees.

“Collectively, leadership of the Navajo Nation is equally concerned that environmental organizations have made a point to target Chaco Culture National Historical Park for political or financial gain,” Freeland said, “without listening or taking into account the people who are from the region. Chaco Canyon is located on Navajo Nation lands.”

At the forum, he noted that the National Park Conservation Association has been one of the primary advocacy groups to launch a campaign for buffers around national parks most threatened by oil and gas production, and Chaco Canyon was on top of their list.

Freeland reemphasized that those living in the Chaco Canyon area have been ignored, and for the past six years Congress has considered multiple proposals to create a buffer zone around the historical park at the additional request of the All Pueblo Council of Governors.

“Protecting Indigenous lands is important for future generations to understand our country and to respect the Pueblos’ sacred culture,” said Theresa Pierno, president and CEO of the National Parks Conservation Association after Haaland announced her decision.

“There are limits to this administrative protection, as 20 years is significant but also the equivalent of an eye blink on this timeless landscape,” Pierno said. “The National Parks Conservation Association calls on Congress to finish the job and approve legislation championed by the entire New Mexico delegation to permanently protect the region.”

Those who live around Chaco Canyon, who were born there before it became a National Historic Park, and are descendants of those who lived in the area for generations have always expressed their dismay about a buffer zone and Haaland’s stance on the issue.

Delora Hesuse is a Navajo allottee and has been advocating on the allotments and the challenges of what fellow allotment owners are trying to let people know. One conflict is Haaland’s position on Chaco Canyon and whether she would be able to really listen to those living in the area.

“There is a conflict with everything that is going on,” said Hesuse, adding that Haaland “never once met with us when she was a congresswoman. I say this too, as another Native woman, does she have respect for other tribes? Does she have respect for us?”

She described the elders who receive royalty payment from oil and gas and said they are grateful. This income from oil and gas is income that Navajo allottees depend on and they are living a better life because of it. She also noted she has never heard of anyone getting sick from the effects of oil and gas production.

Within the Navajo Nation, 35.8% of households have incomes below the federal poverty threshold, and about 10% live without electricity. The Chaco Canyon drilling ban would strip an energy source from the Navajo Nation, and could cost Navajos an estimated $194 million over the next two decades.

“We have all these environmentalists coming in and telling us how we should be or how we should live,” Hesuse said. “Remember, we are the first people here.”

President Joe Biden appeared in a press conference where he said “I’ll just follow my orders here.”

On Sunday, the 46th president spoke at a conference in Hanoi Vietnam and met with General Secretary Nguyễn Phú Trọng of the Communist Party of Vietnam.

Biden stood at the podium and read his prepared remarks while looking at his notes for the majority of the time.

After the speech, the Democrat delivered a press conference where he opened up another discussion by reportedly making a joke about the Vietnam War and asking for questions from reporters.

Biden stated that he would take questions from five reporters, but he could not locate the paper list of particular reporters he was supposed to call on that was prepared by White House officials.

He then proceeded to say that he will just “follow his orders from staff.”

At the end, Biden declared that he was “going to bed,” appearing more irate and mentally disoriented.

Due to Biden’s senile mannerisms, his critics have frequently called him “Sleepy Joe,” and online users have commented and poked fun at the press conference footage.

“I’ll just follow my orders here. Uh — Staff, is there anybody that hasn’t spoken yet? I ain’t calling on you! I told you, I only have five questions!” He shouted.

But all have the same thing in common. Violating people’s first Amendment rights. If it’s not parents it’s other politicians, lawyers, or people from the business world like Musk.
