Yes, the illegals have most of the same Constitional rights as American citizens. But due process is a slippery slope. Illegal Immigration Reform and Immigrant Responsibility Act of 1996. does allow this. Under the expedited removal process, immigrants who have been in the country illegally for less than two years and are apprehended within 100 miles of the border can be deported almost immediately without going through a court hearing.
The exception is asylum seekers, who must be granted a hearing. But you have many on the left are demamnding a full-blown trial for the millions of undocumented. Here’s how you fix that. Give it to them, but they must wait in their home country for that trial. Problem solved.
